Old Monk vs Old Mist: What is that?
In June 2025 there was a dispute between the old manufacturer of the monk Mohan Meaking and the old fog manufacturer Eston Roman Brewery & Distillery. The caller Mohan Meaking “pioneer” in the liqueur industry, the justice bench Ajay Mohan Goel on High High Court Himachal noted that Eston Roman Brewery & Distillery is a relatively new company, while the old monk manufacturer has a registered trap of its product Monk Coffee up to 22 November 2031.
The court noted that the defendant’s product was essentially similar to the registered trademark of the plaintiff “Old Monk Coffee”, as well as the appearance.
“Under these circumstances, if the breach is allowed to continue, it is likely that the public would cause confusion and the defendant would obviously be able to pass on its product as the applicant,” the order said.
Given the “balance of comfort” and the potential of “irreparable loss”, the court ordered the restriction of the sale and distribution of the Old Mist coffee rum, in the victory for Old Monk Coffee.
What now?
After ordering HC, Eston Roman Brewery & Distillery will not be able to sell Old Mist Coffee Rum until the next warning.
Meanwhile, the old manufacturer of the monk Mohan Meaking was ordered to deliver the order to the court order together with the defendant support documents, in accordance with Regulation 39 Rule 3 of the Civil Code (CPC).
