The new Delhi, April 18 (PTI), reported on the global trading body of the WTO that the decision to deposit tariffs on steel and aluminum was based on the reasons for national security and should not be considered as a measure according to communication.
The US shared this reaction with the World Trade Organization (WTO) after India asked for consultations on the basis of an agreement on WTO 11 April with America.
India said that, regardless of the characterization of these US measures as security measures, there are essentially measures.
She also stated that America was unable to inform the WTO Committee for warranty on the basis of the provisions of the Agreement (AOS) on the adoption of the decision to apply measures.
“The US Notes That The Premise for India’s Request for Consultations Under Article 12.3 of the Agreement on Safeguards is that the tariffs are safeguard measures …. The (US) President Imposed the Tariffs on Steel and Aluminum Pursant to Section 232 Tariffs are Necessary to Adjust Imports of Steel and Aluminum Articles that Threaten to Impair the National Security of the Us, “America Has Said in A Communication, DataD April 17, to the Business Authority.
The US also stated that section 232 is the status of national security and tariffs are maintained on the spot according to the security exemption permitted under the provisions of the General Agreement on tariffs and trade (GATT) 1994.
He added that the tariffs were not deposited in accordance with the provisions of the Commercial Act of 1974, which is a law under which the US imposes measures.
“The United States does not behave these steps according to the provisions on warranty / emergency measures … These measures are not secured by measures and therefore there is no basis for consultation on the basis of an agreement on these measures,” the US added.
“In accordance with the Indian request for consultation … it is not based on the warranty agreement,” she said, adding: “We are open to discuss this or any other India problem”.
On March 8, 2018, the US declared warranty measures on certain articles from steel and aluminum by imposing 25 % and 10 % of the AD Valor tariffs. It entered into force from 23 March 2018.
On 10 February of this year, the US revised measures for guarantees for imports of steel and aluminum articles that were effective from 12 March 2025 and for unlimited duration, communication said.
