
On Friday, the Supreme Court noted that it is increasingly acting as a marital and Kauco court due to the growing number of cases preceding before him, according to the report Bar and Bench.
The bench consisting of Justices Vikram Nath and Sandeep Mehta made this remark while considering a request from an army officer. The officer asked for assistance to the court in proceedings for marital cases that was repeatedly adjourned before the High Court in Rajasthan.
The bench noted that although constitutional matters are waiting for hearing, the court is increasingly burdened with marital disputes across the country and notes that it can soon become a marital court.

“If we start to entertain these matters for being postponing, this court would be flooded with divorce petitions from all over the country … All divorce matters will come to court.
A lawyer representing an officer of the army claimed that he had not heard the case of the High Court, although he was listed several times. On this basis, he asked for the Supreme Court’s intervention. He also asked the court to issue a notification of mediation to help achieve the settlement.
Judge Nath, however, warned that if the court began such a pitiful amusement only on the basis of adjournment at the High Court, this could lead to a tremendous increase in marital cases throughout the country.
“If we start to entertain these matters for postponing …. This court would be flooded with divorce petitions from all over the country,” Judge Nath said.
After these observations, the lawyer asked the petitioner for permission to collect the action and had to be allowed for early hearing to the High Court. The court complied with this application.
