Judge Washington blocked the recovery of the military ban on transgender of the individuals of US President Donald Trump and recently described the second nationwide order against politics, said AP.
The case has been released at the US District Court for several long -serving Transgender military members who marked the ban on offensive and discriminatory. They also claimed that the ban would damage their career and reputation.
The 65 -page decision said that Trump’s administration had not explained any explanation why Transgender individuals who have served the army in the last four to five years are suddenly prohibited.
What did the US judge say?
“The government’s arguments are not convincing and it is not a particularly narrow question in this record,” said the US judge of the US District Court Benjamin Setttle.
“Government relying to the respect for military judgment is unfounded if there is no evidence supporting the new judgment of the army reflected in a military ban,” he added.
Previous decision
Last week, the US district judge Ana Reyes issued an order blocking Transgender Policy in Washington. However, the order was temporarily suspended due to the dismissal of the government.
The US Court of Appeal stated in Columbia that the decision would come into force if “any step that negatively affects” Members of the Transgender Service.
In another limited decision on Monday, New Jersey’s judge prevented the Air Force from eliminating two Transgender men and said it would seriously affect their career.
Trump’s ban on transgender from military service
On January 27, Trump signed an executive order that claimed that the sexual identity of the transgender members “conflicts with the commitment of a soldier to an honorary, true and disciplined lifestyle, even in his personal life”.
In response to this order, Minister of Defense Pete Hegset issued a policy that disqualifies Transgender people from the army.
“They can make the right number of pulpus. They can make the right amount of clicks. They can shoot straight.” Nevertheless, they are told that they have to leave the army simply because of who they are, “said Sasha Buchert, a lawyer with a legal law firm for Lambda civil rights.
In the US, thousands of individuals of the military transgender are used, but account for only 1% of the total military force. The Ministry of Defense policy made it possible to serve the Transgender people in 2016. Donald Trump during his first term at the White House issued an order to ban members of the Transgender Service, except for those who have already begun to move according to the milder rules that were in force during Obama’s administration.
