Prosecutors will not seek the death penalty for Nick Reiner if he is convicted
Los Angeles County District Attorney Nathan Hochman announced the decision Tuesday ahead of Reiner’s scheduled electronic trial hearing. If Reiner is convicted of the murders, prosecutors will instead seek life in prison without the possibility of parole.
The decision marks a significant development in a case that has drawn intense attention because of the identity of the victims and the family relationship at the center.
Rob Reiner, 78, ad Michele Singer Reiner, 70, was found fatally stabbed on December 14, 2025 in his home in the Brentwood neighborhood of Los Angeles. Nick Reiner was arrested hours after their deaths and subsequently charged with two counts of first degree murder. He denied it.
What do the plaintiffs claim?
A grand jury later indicted Reiner on a charge of murder, adding a separate allegation that he lay in wait before the murders. The indictment also includes allegations related to the use of a knife and the deaths of several victims, circumstances that made the death penalty possible.
The latest ruling means the death penalty will no longer be on the table if Reiner is convicted. His maximum possible sentence will instead be life in prison without parole.
Hochman said the decision followed a review of the case and consultations that included the victims’ family. According to NBC Los Angeles, the prosecutor said that family members of Rob and Michele Reiner made their views clear and that those views were taken into account before prosecutors decided on the death penalty.
The case continues despite the decision
The decision does not change the murder charges against Reiner or determine the outcome of the case. He remains accused and prosecutors will still have to prove their claims in court.
Reiner’s guilty plea was entered in February. His former attorney, Alan Jackson, withdrew from the case in January, after which a public defender took over his representation. Reiner remained in custody without bail.
The case also unfolded against the backdrop of renewed public attention regarding Rob Reiner’s career. The acclaimed actor and director, known for films such as This Is Spinal Tap, When Harry Met Sally… and The Princess Bride, was remembered at the Emmy Awards after his death in 2026. He also received a posthumous Emmy Award for his guest role in The Bear.
Emma’s tribute came just days before the latest developments in the criminal case involving his son.
For the Reiner family, however, the trial remains separate from the public memorial of Rob and Michele. The prosecution’s decision narrowed the scope of the possible punishment, but does not bring the case to an end.
Nick Reiner still faces two counts of first-degree murder, and the charges against him must go to trial. A conviction would mean the possibility of spending the rest of his life in prison without parole.
