The divisional bench of the Madras High Court on Thursday (July 3, 2025) confirmed the order of a single judge against the re-fraudulent national competence-cum-entrance-school (Neet-G) 2025 for students appearing in centers that suffered from heavy rains.
The divisional bench, including judge J. Nish Ban and M. Jothiraman, dismissed an appeal against a file brought together by a group of candidates by consent to the submission of another generalist AR.L. Sundaresan that the disturbance of force had no significant impact on the performance of the petitioners in the test.
The bench confirmed the decision of justice C. Kumappan 6 June to order the Neet-G 2025 re-permit and stated that the free judge had concluded that any court order would seriously affect the prospects of more than two million candidates.
Although the petitioners were questioned at the order of the only judge, they argued that the centers were completely distributed to the test conditions, where the energy had a failure due to severe precipitation, and therefore the candidates in these centers lost the advantage of writing tests in the same level as in other centers.
However, Mr. Sundaresan created the CCTV shots from the investigative centers in front of the divisional bench to show that the investigative halls had large windows with glass panels that allowed the surrounding daylight to enter the rooms and that due to rain and power outage, there was a very negligible disturbance.
He also pointed out that one of the candidates in the Center in question answered 179 out of 180 questions, and five other candidates answered 140 out of 180 questions. He said there was no difference in the performance of candidates who had suffered a power failure in their centers and others.
He also stated that the NTA established an independent expert in the Earth assessment to see if it has any impact on the performance of the applicants due to power failure in some centers and that the committee had conducted a statistical analysis prior to categorical findings.
FINDING FORCE IN HIS SUBMISSIONS, The Division Bench Wrote: “This Court is of Opinion that is Crucial to Uphis SPEAKING ORDER PASSED BY NTA, AFTER FIELD VERIFICATION OF EXAMINATION CENTRES AND STATISTICAL Analysis by an Independent Expert Committee with no Affiliation to the NTA, UNLESS DRA DECISION IS DECREED TO BE Manifestly
Taking acknowledging that up to 22 Lakhs appeared for Neet-Ug 2025 and that the whole list of rank would be disturbed if the review for selected candidates were ordered, so the bench said:
