OFFICIAL RULES
Please read these Official Rules carefully. By participating in this Sweepstakes, you agree to these Official Rules.
1. ELIGIBILITY:
No purchase or payment of any kind is necessary to enter or win. A purchase will not increase your chances of winning. Void where prohibited. The Sweepstakes is open to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older. Employees, officers, directors (and their immediate families, e.g., spouse, children, parents, siblings) and those living in their same households (whether or not related) of MyFitnessPal, Inc. (“Sponsor”) are not eligible to enter. To participate, you must follow MyFitnessPal on Instagram (@myfitnesspal) and be an active member of the MyFitnessPal Instagram Broadcast Channel. Eligible participants are referred to as “Participants” or “you.” By participating, you agree to these Official Rules and to the decisions of the Sponsor, which are final and binding in all respects.
2. PROMOTIONAL PERIOD:
The Sweepstakes begins on March 6, 2025, at 12:00 PM Central Time (CT) and ends on March 13, 2025, at 12:00 PM CT (the “Entry Period”). Entries must be received and recorded by the Sponsor during the Entry Period. Sponsor’s clock is the official timekeeping device for the Sweepstakes.
3. HOW TO ENTER:
To enter, follow these steps:
- Follow @myfitnesspal on Instagram.
- Join the “Nutrition For Real Life” Instagram Broadcast channel.
- Like the official Sweepstakes post on Instagram.
- Tag a friend in the comments (collectively, the “Instagram Entry”).
If you are not already a member, create and sign into a free Instagram account, agreeing to Instagram’s terms of service and privacy policy.
Alternatively, you may enter without completing the Instagram Entry by emailing community@myfitnesspal.com with your full name and email address.
Limit one (1) entry per person. You may enter via Instagram or email, but not both. Sponsor reserves the right to verify all entries and disqualify any entrant who violates these Official Rules. All eligible entries will form the pool of Qualified Entries, from which the winner will be selected.
4. DRAWING:
Within thirty (30) days of the Entry Period’s end, Sponsor or its designee will conduct a random drawing to select one (1) winner (the “Winner”) from the Qualified Entries. If a Winner is disqualified or fails to claim the prize, Sponsor may, at its sole discretion, select an alternate winner (the “Alternate Winner”).
Winners will be notified by email. Sponsor will use reasonable efforts to deliver the prize within ninety (90) days of the drawing, provided the Winner supplies a valid mailing address. If a Winner does not respond within 48 hours or is found ineligible, the prize will be forfeited, and an Alternate Winner may be selected.
5. PRIZE, ODDS OF WINNING, APPROXIMATE RETAIL VALUE (ARV):
The prize includes:
- A one (1) year subscription to MyFitnessPal Premium (ARV: $79.99).
- One (1) Theragun (ARV: $199).
Total ARV: $278.99.
Unspecified costs, expenses, and taxes, if any, are the Winner’s responsibility. No prize substitution is permitted except at Sponsor’s discretion for a prize of comparable value. The prize is non-transferable. Odds of winning depend on the total number of Qualified Entries received.
6. DISQUALIFICATION:
Sponsor reserves the right to disqualify any Winner or Alternate Winner for:
- Providing inaccurate personal or contact information.
- Undeliverable notifications.
- Tampering with the entry process, violating these Official Rules, or acting in a disruptive or non-sportsmanlike manner.
Upon disqualification, the prize is forfeited, and Sponsor has no further obligation to the disqualified Participant.
7. LIMITATION OF LIABILITY:
The Released Parties (defined below) are not responsible for:
- Incorrect or inaccurate information.
- Technical difficulties, malfunctions, or interruptions.
- Bugs, viruses, or malicious attacks.
- Typographical, mechanical, electronic, or human errors.
- Lost, incomplete, late, or misdirected entries or transmissions.
- Unauthorized human or mechanical intervention.
Participants acknowledge that everything provided for the Sweepstakes is provided “as is” without warranties of any kind. Some jurisdictions may not allow limitations or exclusions of liability, so some provisions may not apply to you.
8. RELEASE:
By entering, Participants agree to abide by these Official Rules and release Sponsor, its officers, directors, employees, representatives, and agents (“Released Parties”) from any liability for injuries, losses, or damages of any kind arising from participation in the Sweepstakes or use/misuse of the prize.
In the event of a Force Majeure (e.g., natural disaster, pandemic, government action), Sponsor may abbreviate, modify, suspend, cancel, or terminate the Sweepstakes without further obligation.
9. DISPUTES AND ARBITRATION; JURISDICTION AND VENUE:
Except where prohibited, disputes will be resolved through binding arbitration under the American Arbitration Association’s rules, conducted in New York County, New York. Participants waive the right to a trial by jury or to participate in a class action or representative capacity. Claims must be filed within one (1) year of arising or be forever barred.
If arbitration is unenforceable, disputes will be subject to the jurisdiction of state and federal courts in New York County, New York, and governed by New York law. The prevailing party in any dispute is entitled to recover reasonable costs, including attorneys’ fees.
10. WINNER’S LIST:
For a list of winners, email community@myfitnesspal.com within 60 days of the Entry Period’s end. Limit one (1) request per email address.
11. PRIVACY POLICY:
By entering, Participants agree to Sponsor’s privacy policy, which governs the use of personal information collected in connection with the Sweepstakes.
12. MYFITNESSPAL’S TERMS AND CONDITIONS OF USE:
The MyFitnessPal Terms and Conditions of Use are incorporated into these Official Rules.
