
The Kerala High Court restrained the authorities concerned from allowing anything other than the receipt of land tax from persons living on the disputed land in Munambam, which the Waqf Board claimed was Waqf property.
After being informed that the authorities had allowed the mutation and also adopted the register of rights beyond what was allowed in the earlier order of the court, the court orally observed that the court had only allowed the payment of tax and nothing beyond that. The court was hearing a number of petitions, inter alia from the Munambam Bhoo Samrakshana Samiti and people who lived on the said land. The matter was posted for hearing on January 14.
600 families
The Supreme Court had in November, through an interim order, ordered the revenue department to temporarily collect land tax from more than 600 families in the disputed land in Munambam. This followed a plea by the Samiti and others who alleged that the village official in question was not accepting the tax, citing the claims of the Waqf Board over the property. So they requested the district collector and tahsildar to accept the land tax and carry out mutation, transfer, issue of encumbrance certificate and also changes in Tandaper register in respect of the property situated in Kuzhuppilly village. The court then permitted the officials concerned to temporarily collect tax from the petitioners and similarly situated persons, subject to the outcome of the land proceedings pending before the Supreme Court.
