
The Ernakulm district commission has ordered the mobile service to compensate the customer for not correcting his mobile phones, even though they collect services.
The bench, consisting of President DB Bin and members of V. Ramacandran and TN Sreevidhia, issued an order of 27 March 2025, which directed the unit to repair phones within 30 days. If the repair is not feasible, the company will return the complainant 13,700 GBP and return the phones. The complaint was filed by an amblalamic native on May 5, 2023.
The company was ordered to pay 5,000 GBP as a compensation for mental agony and suffering caused by the complainant because it was found guilty of lack of service, unfair business practices and the resulting physical and mental suffering. According to the order, another 3,000 GBP should be paid for the costs of driving.
The inability to repair the phones despite receiving the agreed service fees was a clear lack of service, as defined under Section 2 (11) of the Consumer Protection Act.
