
Kerala State Medical Council (Modern Medicine) decided to remove the name of the registered doctor from the state medical register for three months and imposed a 1 lakh, for practicing with unrecognized and unregistered qualifications, ignoring previous warnings and repeated Council directives.
This is the second case recently when a KSMC crackling whip to ensure that all registered doctors follow the ethical instructions of the professional behavior of regulating the practice of medicine.
The complaint that Collin Alphonse, a registered doctor in Thiruvananthapuram, reported unrecognized and unregistered additional qualifications, while in clinical practice the Council received the Council of Modern Medicine Council on June 14, 2022.
During the hearing, the doctor stated that although after training between 2007 and 2010 he appeared for DNB examination (medicine), the result was not declared. He claimed that in 2016 he received MD in medicine and a doctorate in medicine in 2019 from Nicaragua, Central America. He claimed that he had applied for a certificate of equivalence from the National Medical Commission (NMC) and that the Registration process was started with NMC.
Dr. Alphonse said that since 2019 he has been practicing in Jubilee Memorial Hospital and claiming that he did not know that unregistered qualifications should not be displayed for medical practice. He stated the obligation to the Council of the Correction measures and also apologized.
Ethics attitude
However, the Ethics Commission found that the claim that Dr. Alphonse asked for an equivalence certificate was misleading because the NMC does not issue such a certificate. Location of the displayed Dr. Alphonse was not mentioned as a recognized NMC qualification and practiced for three years using these qualifications.
The Council stored on Dr. Alphonse a fine of 50,000 GBP and ordered him to remove unregistered qualifications from his name tag, official seals and regulations and submit documentary evidence to the Council.
However, with the exception of payment of a fine of 50 000 GBP, Dr. Alphonse refused to observe the rest of the directives, even after the reminder was sent. 22 February of this year KSMC during a surprising inspection in Jubilee Memorial Hospital found that Dr. Alphonse continued in practice and showed qualifications, MD (medicine), PG in diabetology and FCCM (critical care in FC).
The Council then issued him a notice of the cause of the show and ordered him to appear in front of the advice. In his performance on June 21, Dr. Alphonse accused the hospital administration for the inclusion of qualifications on the council located outside his consulting room.
The attitude of the doctor
He said that after receiving the notice of the cause of the show, he ordered the hospital authorities to remove the unregistered qualifications from the title. Dr. However, Alphonse admitted that he was using the same qualifications in other areas where he had clinical practice, “he thought that the instructions of the Council were only related to the practice in Jubilee Memorial Hospital”.
However, the Council considered Dr. Alphonse for responsible for repeatedly ignoring his directives and continued his unauthorized practice, although in 2022 he paid the sentence for the same crime.
“He’s not a specialist”
KSMC 3rd July decided to remove his name from the state medical register for three months and noted that he had neglected his professional responsibility for ensuring accurate and legal public representation. Dr. Alphonse was also ordered to carry out corrective measures; Do not show unregistered qualifications and not say that it is a specialist until he has been properly qualified.
The doctor has the right to appeal before ethics and the Medical Registration Council of the National Medical Commission pursuant to Section 30 (3) of the NMC Act of 2019 and according to regulations 8.8 of the Indian Medical Council (professional behavior, etiquette and ethics), 2002.
