
The prosecution in the sexual assault case registered against Palakkad MLA Rahul Mamkootathil on Tuesday submitted to the Thiruvananthapuram Magistrate’s Court First Class III that he violated the basic conditions of his bail.
Seeking immediate cancellation of the anticipatory bail granted to the ousted Congress leader, the prosecution accused him of trying to influence the survivor after she made her confidential statement to the court.
The prosecution claimed in its opening statement to the court that the accused had tried to make contact with the survivor, despite a clear bail condition prohibiting any such communication. The bail order specifically directed that the accused “shall not attempt to directly or indirectly contact the survivors”.
According to the Special Investigation Team, the accused tried to reach the survivor through WhatsApp calls. This prompted her to alert the police about the approach.
The prosecution also said the survivor was allegedly picked up from a bus stop on the day they first met and taken to the family where the assault took place. As other women have made similar allegations, the court has previously imposed strict conditions to ensure the safety of the witness and the integrity of the investigation. By disobeying the court’s order to refrain from any form of contact, the accused forfeited his right to remain on bail, the prosecution said.
The case will be heard further on March 13.
