The Allahabad High Court in Uttar Pradesh noted that couples that married their own will against the wishes of their parents cannot require police protection as a right unless their lives and freedom are realized.
The court issued a decision to decide on a request submitted by a couple seeking protection. The court stated that it could ensure the safety of the couple in a well -deserved case. But in the absence of any perception of the threat, such a couple must “learn to support each other and face society,” he said.
Judge Saurabh Srivastava made this observation and heard a written petition submitted by Shreya Kesarwani and her husband, who was looking for police protection and the direction of private respondents, not to interfere with their peaceful marital life.
Learn to face society: HC
“In a well -deserved case, the court can provide a couple of certainty, but cannot provide them with the support they have been looking for. They must learn to support each other and face companies,” said April 4.
After the averages made in their petition, the court set up their written petition and noted that the petitioners had no serious perception of threats.
“There is no requirement to approve an order for the provision of police protection in the light of the judgment made by the Supreme Court in the case of Lata Singh vs State of Up and others, where it was decided that the courts are not intended to ensure protection to these young people who simply fled to marry their own wishes.”
The court also noted that there was no material or a reasonable basis to conclude that the lives and freedoms of the petitioners were threatened.
“There is also no iota evidence that would prove that the privacy (relatives of one of the petitioners) are likely to cause a physical or mental attack on the petitioner,” said the court, as stated by the PTI.
“Find the real perception of the threat”
The Court noted that the petitioners did not file a specific application in the form of information to the police authorities in order to submit any companies against the alleged illegal behavior of private respondents.
However, the Court noted that the petitioners had already submitted to the police guide (SP), the Chitrakoot district, stated: “If the police concerned find the real perception of the threats, they will do the necessary in accordance with the law.”
The court stressed that if someone behaved or did not behave, the courts and police authorities are there to come to their rescue.
Couples must learn to support each other and face society.
In its order of April 4, the court destroyed a reason and ruled that the petitioners could of course or correctly require security.
