
The Kerala government will not join the case of the WAQF Act for the time being in the Supreme Court, which challenges the validity of the enactment, even if several state governments led by the BJP have already proceeded to support legislation. The Supreme Court should consider this case on Monday.
The Supreme Court has previously stated that only five proposals will be considered in this case and other petitions would be considered to be an intervention or the assumption of petitions. The court stood up as a large number of petitions in this case. The Kera Waqf Council, which is an opponent in two cases related to the Munambam countries waiting for the WAQF, took the opportunity and submitted a proposal to be submitted in the present case.
Six countries controlled by BJP, including Madhya Pradesh and Assam, supported the constitutionality of the WAQF law (Appendix), 2025, at the Highland Court. KPI (m) LED Kerala was one of the first state governments in a country that was strongly opposed by legislation. Opposition parties led by Congress have teamed up with the state government to unanimously adopt a resolution in the State Assembly and call on the Union’s government to abolish this step.
The attitude of the State Government and the Waqf Council in the matter is greatly monitored by various community organizations in the state, because the dispute over Munambam, which was reportedly given as WAQF at Faroook College, led to an unusual sociopolitical situation in the state. BJP offered its support for agitation led by several organizations associated with the Church.
“Waiting and tracking mode”
“The state government is currently monitoring the development of the Supreme Court. We are in the waiting and tracking regime,” said P. Rajeeve, Minister of Law.
State government lawyers at the Top Court confirmed that they had not received any instructions on the petition. Interestingly, the state government understands that it has previously explored the legal possibility of involvement in the case. However, the last call was not accepted.
Church leadership
Meanwhile, part of the Church’s leadership met with Mr. Rajeeve last week and sought the government’s support to resolve Munambam Imbroglia. Several leaders of protesters who hoped that the enactment of legislation would immediately solve the problem of land, expressed their irritation over the possibility of a prolonged legal battle to obtain income rights to their possession.
