The Kerala High Court on Monday stayed for a month all proceedings related to the notification issued on November 5 under the Kerala State Electricity Regulatory Commission (Renewable Energy and Related Matters) Order 2025.
The court ordered a stay of execution, execution, enforcement and all other proceedings related to the notice. This follows a plea by the Domestic On-Grid Solar Power Prosumers Forum-Kerala challenging the proposed new regulations as well as the appointment of KSERC members, alleging that the independent body has been captured by the Kerala State Electricity Board (KSEB).
During the hearing of the plea on November 3, KSERC said it will issue a notification only after considering the objections raised during the public hearing, which may take about one month, Justice Mohammad Niaz CP observed
It further issued a direction to the state government, KSERC and KSEB to file counter-affidavits on the grounds/contentions raised in the suit so that the court can consider the legality and validity of the November 5 order. The matter was remanded for hearing on December 1.
