
The High Court in Kerala strengthened the compensation of the young victims of a road accident that was fully affected after a weakening accident, from 11 lakh to 53 lakh.
Sumisha of Thrissur, now at the age of 26, was only seven years old when she met an accident in 2006 and has since lived in an orphanage. In 2009 and her father, she lost her mother in 2020, while her sister lives with her husband. The court quoted these circumstances between the reasons for the revision of the earlier granting 11 lakh awarded by the Tribunal for Motorbikes (MACT), Thrissur.
Her council said she was completely in bed and couldn’t move out of bed because all four limbs were broken due to the impact of the accident. In his report, the Office of the District Legal Services, Thrissur, stressed that she could not move alone and had to be excluded from her room in a wheelchair. Her sister and orphanage staff described how her health was in critical condition.
At the time of the accident, a student of class 1, at the time of the accident, could not continue her studies because of the injuries she suffered in the accident. She could not enjoy the life of a child, adolescent or youth like others. She would also lack fun of her childhood, the excitement of her youth and the pleasure of her marital life and couldn’t have children. She couldn’t enjoy the beauty of nature. She couldn’t even go inside the room in which she was limited, without her own guilt, the court stated that he sought to strengthen the quantum of compensation when issuing a petition filed with Sumisha.
