The divisional bench of the High Court in Keral on Tuesday canceled the Waqf Court in Kozhikode, which refused the action for the Ceral State Waqf Council for calling records from the subordinate court, North Paravur in the Ernakula district, regarding cases of dispute.
The justice bench Amit Rawal ordered the court to decide again by the WAQF Council. The Board of Directors tried to call for records because they have a direct impact on the ongoing proceedings concerning the country of Munambam before the tribunal.
The court approved the directive and at the same time allowed the proposal filed by the WAQF council, which challenges the tribunal order.
The Court noted that the manner and regime in which the request for the WAQF Council was rejected was not acceptable and sustainable in the eye of the law because it did not reflect any arguments, discussions or requests or across across.
