
The Kerala Administrative Court issued an order issued by the local self -governing department (LSGD), which transferred former Minister Munnar Grama Panchayat GP Udayakumar after the State Election Commission Directive (SEC).
Mr. Udayakumar was transferred after being charged with “serious abandonment” in adherence to Keral Panchayat Raj (resignation of the President, Vice President or Members), 2000, accepting the resignation letter of former President Munnar Grama Panchayat Deep Rajkumar.
Mrs. Rajkumar submitted 29 February to her resignation to the Secretary Panchayat just to push her a few hours later and claim that she was forced and that her signature in the original letter was created by her political rivals.
Minister Panchayat handed over both SEC letters, which later allowed Mrs. Rajkumar to continue office and ordered LSGD to transfer Secretary Panchayat. Was then converted to Thuneri Gram Panchayat in Kozhikode
The Kat divisional bench, consisting of the chairman of the CK Abdul Rehim and the administrative member of Pradeep Kumar, considered the transfer unsustainable. The Tribunal ruled that neither SEC nor its secretary (who recommended the action) did not hold the administrative body over LSGD or had the power to recommend disciplinary proceedings.
He confirmed the petitioner’s assertion, represented by the defense attorney Fathahudeen M. that the Secretary of SEC was not legally entitled to make unfavorable notes against the secretary Panchayat.
The tribunal ordered the tribunal to order the LSGD to refuse the justification of the SEC that the “request” to protect the interest of justice and to avert any procedural misfortune was filed.
