Madurai Bench of the Madras High Court refused to order the CBI probe on the incident of Karur Stampede, which resulted in the death of 41 people during the Rally actor Vijay’s Tamilaga vetr kazhagam (TVK) in the district of 27 September (Saturday).
The court also ordered the state government not to provide permission of any political party or organization for performing public meetings on national and state motorways until standard operating procedures (SOP) were introduced.
The divisional bench of Justices M. Dhandapani and M. Jothiraman rejected a petition of lawsuits about the public interest looking for a CBI probe into the incident. The Court took into account that the investigation of the case was in the nascent phase and no accusations were made in terms of the method of investigation, nor the interference of the state or its machinery.
To ask the court as to whether it was granted permission to make an event on the state highway, the state said that the place was adjacent to the highway and it was not on the highway.
Given the fact that matters concerning the SOP for such events awaited before the Madras High Court, the court ordered the state government not to provide permission to any such events on national and state motorways until the SOP was introduced. The state also issued an enterprise that no party would be granted any permits to carry out public meetings on national and state motorways.
The court ordered the authorities to earn such events in the places that the organizers follow safety measures, including the provision of drinking water, ambulance medical facilities, proper hygiene, sufficient parking space and other basic facilities.
The permit should only be granted for the management of events only in the places allocated. If there was no space, the agency should invite the organizer to identify the place and, after satisfaction in terms of the suitability of the place so that the public does not have any public obstacle and free vehicle movement, the meeting after obtaining an enterprise from the organizer, ordered the court.
When granting permits, the authorities should ensure that escape routes and ranging routes for free vehicle movement such as ambulances and other vehicles are provided at the designated session and that there is no obstacle, the court ordered a dose of public disputes that sought the direction against the SOPS to SOPS. SOP.
The court also rejected a petition that sought an increased compensation. The investigation did not mark his fingers on any political party or individual, nor the state government as a reason for StamPede, in which more than 40 lives were lost and many people were injured. In this scenario, the Court cannot provide any direction for reinforced compensation by any political party or state government, unless the fault is strengthened to a specific entity. The application for increased compensation cannot be considered, the court noted.
