The Karnataka High Court has warned that police officers who fail to provide a copy of the First Information Report (FIR) to the accused and others concerned in a criminal case will be subject to a ministerial inquiry for dereliction of duty.
“The law declared by the apex court unequivocally states that the accused has the right to obtain a copy of the FIR without undue delay. Mere assertion that the FIR is uploaded online cannot be a substitute for compliance. Denial of essential data relating to the FIR renders access rights illusory and undermines the very purpose of transparency,” the court said.
