On Tuesday, the High Court in Karnataka ordered the State Government to submit to the Czech Investigation Commission report to John Michael Cunha on the Stampede incident that occurred 4 June outside the M. Chinnaswama stadium in Bengalur.
The divisional bench composed of justice Jayant Banerji and Justice Umesh M. Adiga set out on the petition of DNA Entertainment Networks PVT. Ltd., which challenged the legality of the procedure adopted by the Commission in the conduct of the investigation.
Government request
Meanwhile, the head of the BK Sampath Kumar, who appeared for Networks, told the bench that the function for facilitating the Royal Challengers Bengalur (RCB) on Vidhan’s steps June 4 also organized the DNA network at the request of the state government.
It should be noted that DNA is a manager of events for PVT Royal Challengers Sports. Ltd., who owns a cricket team RCB.
The petitioner’s society questioned the legality of the Commission report and claimed that the Commission had violated the principles of natural justice and, unlike the provisions of the commissions (COI), 1952, because no opportunity for the Cross of Witnesses was given by DNA networks.
Influenced by a reputation
Mr. Kumar also claimed that the company’s reputation was seriously influenced by the Commission’s report in all forms of the media, because the media seems to have all the details of the Commission report, even if the petitioner has not received a copy despite more requests.
Meanwhile, state lawyer General Shashi Kiran Shetty claimed that the DNA network would have to approach the civil court against media publications in the Commission report and stated that the government had nothing to do with publications in the media quoting the Commission report.
DNA Network claimed in its petition that the Commission’s report was released into the media, but was not provided by society, and at the same time stressed that even applications submitted under the RTI law were also rejected.
