
The Division Bench passed the order and dismissed the appeals filed by the trust against the single judge’s verdict dated February 3, 2025 dismissing two petitions filed by the trust in 1999 and 2000 against the land acquisition notification.
A Division Bench of the High Court of Karnataka upheld the verdict of a single judge upholding the notifications issued in 1994 to acquire around 270 acres of land belonging to the Jamanlal Bajaj Seva Trust in favor of the Agricultural Produce Marketing Committee (APMC), Bengaluru, for setting up a large market.
“The appellants have failed to show that the order of the single judge is in any way erroneous and can be interfered with by this court,” said a division bench comprising Chief Justice Vibhu Bakhru and Justice CM Poonacha.
The bench passed the order and dismissed the appeals filed by the trust against the judgment of the single judge dated February 3, 2025 dismissing two petitions filed by the trust in 1999 and 2000 against the land acquisition notification.
The court pointed out the right of the state to acquire land for public purposes under the same conditions in accordance with the provisions of the applicable laws, in the case of the Act on Land Acquisition.
Notification
The notices were issued between 1994 and 1999 to acquire around 170 acres and 100 acres of land in Srigandhada Kaval and Herohalli villages in Bengaluru North taluk, respectively, and the legal battle between the government and the trust had previously seen several rounds of litigation before the Land Tribunal, the High Court and the Supreme Court.
The Bench also confirmed the direction issued by the Single Judge to the State Government to pay compensation to the trust in the amount agreed at the meeting held in September 1999, along with interest at 12% per annum from the date of award of compensation.
