
The government of the left democratic front (LDF) seemed to have suffered a legal and political failure after the Special Court ruled on Thursday that the main minister had no legal position to interfere with anti -corruption surveys.
Commissioner for Investigation and Special Judge, Vigilance and Anti -Royal Office (VACB), Thiruvananthapuram, Manoj, killed Vacb’s claim that his legally questioned a preliminary report on the rich amnasion that caused the main minister to agree with the main minister.
The judge had somewhat frightened that the testimony of Vacb had no position in court and violated the basic principles of jurisprudence.
“What is the role of the so -called constitutional dignitaries in an investigation against a high -ranking police officer? Mr. Manoj sharply noted that the complainant, P. Nagara, a lawyer and public interest in court, testified in court that people who have a high political function and the best bureaucrats were conspired to derail the anti -corruption probe.
In particular, Mr. Nagaraj was appointed by the political secretary of the Chief Minister Pinarayi Vijayan P. Sasi as one of the respondents in his petition. The court described the “pure Chit” Vacb for Mr. Ajith Kumar unacceptable.
Mr. Manoj noted that the court had no power to order the director, VACB, register the case against Mr. Ajith Kumar and other respondents and investigate “criminal offense under the 1988 corruption Act (amended in 2018).
However, the judge wrote that section 223 of Bharatiya Nagarik Surraksha Sanhita, 2023, seized the court to explore the complainants and respondents under the oath before “taking over anti -corruption accusation”.
Mr. Manoj said that the court had enough evidence to conduct such an investigation. In addition, the judge noted that the investigation of the Chief of the State Police against Mr. Ajith Kumar “Prima Facie revealed that the accusation had an angle of vigilance in the form of abuse and corruption and attracted the provisions of the anti -corruption law”.
