A division bench of the Supreme Court, headed by Justice Dipankar Datta, will hear an appeal filed by Vijay-starrer Jana Nayagan’s production house on January 15 against the stay order issued by a division bench of the Madras High Court over the film’s certification.
The bench, which also includes Justice Augustine George Masih, heard KVN Productions’ challenge against the Supreme Court’s two-judge decision to stay the single judge’s order to issue a U/A 16+ certificate to the film hours after its approval.
The production company has summoned the Central Board of Film Certification (CBFC) and its regional director as respondents in the Supreme Court case.
The production firm initially approached the Single Judge Bench against the CBFC Chairman’s decision to review the decision of the CBFC Board of Examiners to allow the film to be issued a censor certificate.
The CBFC responded by stating that one of the five members of the examination board had sent a complaint to the CBFC chairman saying that his objections were not properly considered before the recommendation was made.
She argued that the Cinematography (Certification) Rules, 2024 empowered the chairman to refer a film to a review committee if he disagreed with the examination committee’s recommendation. The Board argued that judicial review of the merits of issuing censor certificates is limited.
