
The Special Court of the National Investigation Agencies (NIA), Jammu, on Thursday (September 11, 2025) decided against its reason to test the Narco two accused in the terrorist attack Pahalgam, which did not leave 26 civilians this year, “without their consent”.
“Given the detailed discussion and the fact that both accused persons have submitted to the court today that they are not willing to undergo a test for polygraph or analysis of NARCO, (NIA) the application is therefore rejected,” said the judge of the additional sessions, the special court said.
The Court ruled that the NIA application for the test was not “maintained in the eyes of the right and needs rejection directly because the agency has not been accepted by any voluntary statement of the consent of the accused in the prisoners in custody”.
NIA was looking for a court permit to perform a test for prints or Narco Analysis of the defendant’s test – Bashir Ahmad Jothatd, son Lal Jothatd, resident Baisaran Hill, Pahalgam, Anantnag, and Parvaiz Ahmed, son of Ghulam Hassan Jother, Pahangam, Anantnag. The investigation agency, which took over the probe into the terrorist incident from J&K April 26, admitted that the test was necessary and that the accused, arrested on April 22, “suffered, provided food and other logistics support to the terrorists before the crime committee”.
“The accused, currently in police custody, are inconsistent in their statements at different points in their statements, which is hindered by the investigation,” the court agency said, submitting that a polygraph or NARCO test need to be carried out.
The accused are ponies riders and belong to the Gujjar-Bakarwal community.
