On Monday (April 7, 2025), the J&K High Court ordered officials to hold a proposal for confidence against the President of the District Development Council (DDC), Budgam after 13 months.
President, Nazir Khan, was removed from this position because no DDC member voted for him.
“They are democratic institutions, if people have lost faith in you, we cannot revive it,” the court noted when passing orders.
In the order of Judge Mohammad Yousuf Wani, he ordered officials to “immediately solve the second petition for importance, strictly under the provisions of the law and the rules that are framed in the basis, and submitted the court by the court by the next date.”
According to the petition filed by defense counsel Abdullah and Zahir Abdullah, Mr. Khan took over as chairman of DDC in 2020 after the DDC elections. However, the elected DDC members unanimously shifted the proposal to trust 19 February 2024.
“Mr. Khan’s behavior and attitude were considered to be harmful to his office for gross misconduct and neglect of duties, which did not touch the chairman,” the court petitioners said.
According to the petition, the court 27 March 2024 ordered the representatives of the Budgam Commissioner to conclude a proposal for trust. The petitioners stated that the official “decided to persist in his intention to resist the court order by not continuing the proposal”.
Meanwhile, Mr. Khan was removed from his position as the chairman after 13 members voted against him.
“This episode lays bare extraordinary lengths into which one individual – supported by the silent protection of the central administration – can go to power.
NC described the removal of Mr. Khan as the chairman of DDC as “a strong assertion of democratic will at the local level”.
“Mr. Khan controversially assumed the chairman in February 2021 via a coin after 7-7 votes. Over time, he faced serious accusations, including the inability of the Council meetings for more than a year; interference in the functioning of fellow citizens and aggressive behavior, especially DDC women,” NC said.
