
A mere act that did not reduce the national flag after the sunset itself is not a crime, unless there is a deliberate action with the intention of offending national honor or expressing disrespect for the flag, the Kiela High Court said.
The police and the court court for the alleged non -resorting of the flag in the municipal office for almost two days after the celebration of independence in 2015 continued to be canceled by criminal proceedings against the Secretary of Angamala. In 1971 and in 1971, the flag in the municipal office did not reduce in 1971.
The justice bench Kauser Edappagath said that simply forfeiture or inaction by a person who did not reduce the national flag after sunset, cannot be considered an act of gross insult or indignation or insult to the flag. The provisions of the 1971 Act cannot be attracted if there is no intentional action with the intention of offending a national honor or expressing disrespect for the flag.
The urban secretary claimed that the accusation against him, even if they are admitted in their nominal value and accepted in its entirety, do not represent a prima facie, or submit the case against it.
