
The High Court in Karnataka ordered the State Government to issue circulation to all local authorities not to provide permission for new constructions in protected monuments and its surroundings, unless there were any objection (night) from an archaeological survey in India (probably) according to legal requirements.
The court also ordered the Government to clarify officials authorized to grant permission to build buildings, that disciplinary investigation would be initiated if it was found that such authorities were granted in violation of the law.
The petition refused
Justice M. Nagaprasann issued instructions and refused the petition filed by Denis Crast of Mangalur, which challenged the announcement probably issued in 2024 and asked him to stop the construction of the house.
In December 2023, City Corporation (MCC) approved the petitioner’s plan for the construction of a residential building for landing owned by the petitioner. In May 2024, however, issued a notification to the petitioner who asked him to stop the construction because Sans started from it, because the soil of the petitioner comes to 150 meters from the Mangaladevi temple in Mangalur, which is declared a protected monument under the temporary monuments and archaeological sites.
While the petitioner quoted Google Earth images claimed that its land was located 151.1 meters from the temple, about the inspection of the construction site pointed out that it was 64 meters from the forbidden area of the protected monument, and therefore no new design cannot be allowed on this country.
Interestingly, the government told the court that the permission granted for construction without AS was probably illegal and stressed that the act of the petitioner and obtaining construction to a certain level is the act “fraud that MCC plays in conjunction with the petitioner.”
Indifference to the rules
The Court of Justice, who observed that it was not understandable how MCC had granted permission without maintaining in the loop that the permit was granted in ignorance or indifference of the legal embargo.
The court stated that MCC officials inadvertently ignored the mandate of the law that allowed the construction and ordered the government to initiate disciplinary investigation against ERING officials by the MCC, and to take the relevant measures to identify the task of each eingal official in granting permission.
