High Court notification by two BRS MLCs

Justice BR Madhusudhan Rao of the Telangana High Court on Monday issued notices to BRS MLCs Thatha Madhusudhan and N. Naveen Kumar Reddy in a criminal petition filed by the police seeking direction to quash a local court order refusing to remand the two MLCs for allegedly abusing the Assembly Speaker.

Two MLCs were arrested on September 8 due to an altercation with the police outside a rally the previous day. The police invoked Section 353 s 3 (5) of the Bharatiya Nyaya Sanhita Act and 3 (1) (r) and 3 (2) (vii) of the Prevention of Atrocities Against Scheduled Castes and Scheduled Tribes Act. However, the First Additional Chief Judicial Magistrate in Nampally refused to take the two arrested MLCs into judicial custody, claiming that mandatory notices under Section 35 (2) of the Bharatiya Nyaya Suraksha Sanhita were not issued to the accused. The police, aggrieved by the local court’s decision to deny the accused’s custody, filed a criminal complaint.

Deputy Commissioner of Police Sultan Bazar M. Mattaiah, who filed the petition, argued that the local court’s order to furnish personal bonds and two sureties of ₹20,000 each, leading to the release of the accused, was arbitrary and illegal. This order was tantamount to granting bail to the MLC accused, the ACP said in the petition.

The matter was adjourned to Wednesday for further hearing.
