On Tuesday, the Theangana High Court declared an order to regulate unregistered land transactions made before 2014 through a set of Bainamas and other forms.
The bench of the main judge Aparesh Kumar Singh and the justice GM Mohiuddin approved this order of liquidation of a petition Pil filed five years ago and sought direction to declare Mrs. no. 112, which allowed the regularization of land transactions performed through the Bainamas set. The order would result in relief to thousands of small farmers who bought and sold land and received agreements written on simple papers and state government.
The Bainama set is a telangana system where unregistered land transactions are listed on ordinary papers. The petition of Pil, in 2020, questioned the decision of the State Government to regulate land transactions made through the Bainamas set. Given that the HC issued an order five years ago, to which the government limited the regulation of these transactions, thousands of farmers feared the validity and property rights of the land sold and purchased.
During the previous hearing, A. Sudarshan Reddy’s general advocate informed the bench that the aim of the state government in evoking GO no. 112 should help small farmers who purchased or sell land without specific legal documents. He told the bench that the government would seize such farmers by ensuring that they have accumulated property rights over the land they bought through the Bainamas set.
He argued that section 6 of the BHU BHHArati law facilitated the regularization of unregistered transactions made before 2 June 2014. The bench noted on Tuesday that the action filed in 2020 became non -intensive. He also noted that Section 6 of the New Testament seized the government to explore and process unregistered land transactions.
