HC will set aside an IPS potency testing order for the participant

Justice J. Sreenivas Rao of the Telangana High Court on Wednesday set aside a lower court’s order allowing the Cyberabad police to subject trainee IPS officer M. Uday Krishna Reddy to a potency test in a sexual assault case registered against him.

But the judge said that the direction will not delay the prosecution from filing the relevant motion if it arises in the matter in accordance with the law. The order was passed in a criminal petition filed by a trainee accused of stalking, harassing and sexually assaulting a fellow trainee IPS officer at the national police academy where they were undergoing training.

As part of the investigation into the allegations against Uday Krishna Reddy in the assault case, the investigators have decided to subject him to a potency test. They were instructed by the Third Additional Junior Civil Judge-cum XXV Additional Judicial Magistrate First Class at Rajendranagar to conduct the potency test.

Citing this lower court order, the IPS trainee filed a criminal complaint. The judge observed that the plea filed by the prosecution in the case was not in accordance with the principles laid down in the judgments of the Madras and Karnataka high courts in similar cases. The order also said that another criminal petition filed by the trainee officer seeking quashing of the First Information Report against him is pending before the HC.
