HC tells the petitioner to make the successful tenderer of Radial Road II

The Telangana High Court on Monday directed the infrastructure company to compel the successful bidder in the tender for the construction of Radial Road-II from Outer Ring Road at Kothwalguda (Budvel) to Shabad in a writ petition filed by the company challenging its disqualification from the tender.

Hearing a series of three writ petitions, Justice B. Vijaysen Reddy of the HC observed that the matter could not be decided without hearing the submissions of the successful bidder as the technical and financial bids had already been opened. Infrastructure company M/s Sushee Infra and Mining Limited, one of the petitioners, sought a direction not to complete the tender alleging that its exclusion from the tender was illegal and arbitrary.

The company said the government disqualified it from the tender on the basis that the experience certificate submitted to it did not comply with the tender conditions and was not countersigned by the concerned senior engineer. It was illegal and violated the principles of natural justice. The petitioner’s legal representative submitted to the council that the company’s practice certificate was valid and he was not given an opportunity to clarify the issues related to it.

The signature of the official in question was not mandatory in the selection process, argued the legal representative. The judge posted the matter for further hearing after the Dasara holiday and directed both parties to file counter-affidavits in the matter.
