The Kerala High Court has quashed the proceedings in a case registered against actor Shweta Menon on charges of acting in films and advertisements that allegedly contained obscene images for financial gain.
Considering the actor’s plea seeking to quash the case, Justice CS Dias said that the allegations would not amount to the offenses alleged against her, even if taken at face value. In addition, the complaint was filed with the motive of tarnishing the name and reputation of the actress, who had no such criminal history, the court stated and canceled the proceedings against her. The court had previously allowed the proceedings against the actor to be temporarily stopped.
The FIR further stated that this content was transmitted through social media and adult sites to gain popularity. She was charged under Section 67(A) of the Information Technology Act, 2000 and Sections 3 and 5 of the Immoral Traffic (Prevention) Act, 1956 after the Ernakulam High Court directed the police on a complaint by Martin Menachery, a resident of Ernakulam.
Refuting the allegations, Ms. Menon said in her plea to the Supreme Court that the films in question had been certified by the Central Board of Film Certification and had been publicly exhibited years ago. The character she portrayed in Paleri Manikyam, which was obscene according to the complainant, won the Kerala State Award for Best Actress.
