
The High Court in Kerala dismissed the petition filed by the employee of the Payyannur bank, who was looking for release from a case in which he was charged with sending news to another private secretary and declared that he “kills Chief Minister Pinaayi Vijayan”.
The rejection of the petition filed by Abjijith M., the court noted that if it were to declare no crime without court proceedings, that there was no crime, it would send an incorrect report of the company. The court noted that there was a growing trend that individuals were sending threatening reports and doing derogatory notes against the constitutional bodies, often in an effort to gain publicity. As a result, the police are forced to spend precious time by determining whether such statements are made only for attention or are powered by a specific motif. Subsequently, persons accused of a crime often approach the court looking for release, either by claiming that there is no crime or by increasing the technical reasons to avoid prosecution.
Day of voting results
The court noted that the petitioner’s reports were sent on the day when the results of the elections were announced in which the left democratic front led by the main minister was recorded by the second consecutive term. Such threatening reports are not only focused on individuals, but are striking in the heart of democracy and ultimately people who participated in a democratic process. She stated that such steps must be solved by the iron hand of the law and must send a strong report of the company.
The court rushed to add that even though the report was sent as a joke or in the moment of emotional emergency after the election results, he was expected that the petitioner who is an educated person would be fully aware of the legal consequences. His actions unnecessarily worry not only another private secretary, but also the whole police machine of the state. Such a person is not entitled to any discretion relief and must face the court in accordance with the law, the court said.
