HC ordered CID, SIT institute to explore Khanamet area

The Telangana High Court has imposed costs of five crore rupees on Ittina Private Properties Limited and its director Manu Ittina and dismissed a suit filed by them seeking rights to 15 acres of government land at Khanamet village in Serilingampally mandal of Ranga Reddy district.

HC Justice Nagesh Bheemapaka, who delivered the verdict on Tuesday in a plea filed nearly 10 years ago, ordered the Criminal Investigation Department (CID) to investigate the “acts of manufacturing and creating fake patta certificates portraying them as genuine documents”. The judge directed the director general of police (DGP) to form a special investigation team (SIT) headed by an officer of the rank of additional commissioner to probe various aspects of the matter and submit a report on the chief secretary’s concurrence within four weeks.

The expenses incurred by the petitioners should be paid into the Chief Minister’s Relief Fund. The investigation should look into aspects of some persons ensuring the record of rights (ROR) proceedings and the possible involvement of officials of the tax office and other ministries in the creation of fabricated documents, the judge said.

The judge noted that it was “plainly clear that the documents were fabricated, government officials became mute spectators and did not initiate any action against the responsible officials”. “This court expresses dissatisfaction with the behavior of the concerned police officers,” the judgment reads.

The patta certificates, submitted by the petitioner, were issued by the Rajendranagar Tahsildar on 5th January, 1972, 23rd April, 1973 and 23rd April, 1973. However, the office of Rajendranagar Tahsildar was established only in 1978. Hence, the said certificates were bogus and fake. Any subsequent entries made in the land records on the basis of the certificate were not valid and no rights would accrue to the petitioners, the judge said.
