The requirement was established by the Supreme Court, instructions issued by the UPSC and a system with one window, the court said.
The Madurai bench of the Madras High Court noted on Thursday that the procedures before appointment must be carefully observed in order to maintain independence and transparency in appointment as the CEO of the Police (DGP) in Tamil Nadu.
The JUSTICES SM SU SU SUBRAMANIAM and G. ARUL MURUGAN Bench said the requirement was well established by the Supreme Court, the subsequent instructions issued by the UNIP (UPSC) public service and one wine system.
Empanelment of officers for appointment at POV DGP was to be performed strictly in accordance with these directives, the court said. The judges took into account the fact that the petition looking for a similar prayer was filed in front of the main seat in Chennai and the coordinate bench on the main chair rejected the petition because it was premature.
The judges agreed to look at the coordinate bench on the main chair, given that the appointment at the DGP station has not yet been carried out. However, they repeated that the procedures before appointment were to be followed to maintain independence and transparency in the case of appointment.
Another general lawyer M. Ajmal Khan, representing the state, said the process of ongoing appointment was in office.
With regard to the submission of an additional general advocate, the court stated that no further interventions in the proposal were required at this intersection, and destroyed a petition in the public interest filed by K. Yasar Arafath of Paramakudi in Ramanathapuram.
The petitioner sought the direction of central and state governments to immediately initiate the Empanelment process of eligible IPS officers at the post of DGP Nadu in accordance with the instructions issued by the Supreme Court in Prakash Singh vs. Union in Lndia. The existing DGP, Shankar Jiwal, is to retire.
