The Kerala High Court refused to entertain an anticipatory bail application filed directly before it by a Kozhikode resident, citing that he should have approached the relevant sessions court.
Referring to the Supreme Court’s recent disapproval of the Kerala High Court’s “circumvention” of the bail courts, Justice K. Babu said the petitioner in this case had not made out any exceptional circumstance to prevent him from approaching the relevant sessions court.
He cited the Supreme Court’s observation that the hierarchy of courts requires that no person seeking redress under Section 482 of the Bharatiya Nagarik Suraksha Sanhita should be permitted or encouraged to approach the Supreme Court directly, though concurrent jurisdiction is vested in both the Sessions Courts and the High Courts. The High Court further rejected his bail application.
