The Food Safety and Standards Authority of India (FSSAI) has issued notices to Nestlé India and Zydus Wellness over “misleading claims” in certain products and asked the companies to provide scientific evidence to support their advertisements.
In a post on social media, FSSAI said that notices have been issued to Nestle India for making misleading claims and substandard promotions regarding two food products ‘Lactogen Pro 1 Powder’ and ‘Nan Excella Pro Stage 1’.
The regulator also issued a notice to Zydus Wellness Product Ltd, making misleading claims and advertising on its food product Complan.
In a notice issued for Lactogen Pro 1 powder, the FSSAI said the company claimed in its labeling and promotional material that the product “contains whey protein, which is a part of milk protein that is easily digestible.”
The food safety regulator has asked Nestlé to provide scientific substantiation for claims that whey protein is easily digestible.
For Nan Excella Pro Stage 1, the FSSAI stated that the claim “5 HMOs (human milk oligosaccharides) help support a normal immune system” was considered a claim that the product is suitable for supporting the immune system.
“The claim was deemed not to comply with provisions prohibiting claims relating to the prevention, mitigation, treatment or cure of any disease, disorder or particular physiological condition unless specifically permitted by the relevant regulations,” the regulator said.
In the case of Complan, FSSAI said the product label depicted two children and claims included “2X faster growth”, “Supports concentration and memory” and “Pro Immunity+ 34 Vital Nutrients”.
The claims were found to be in breach of the FSS (Advertising and Claims) Regulations 2018.
The regulator asked Zydus to provide scientific justification for such claims.
The advertising claim “Growth comes in 4 flavours” was found to be in breach of FSS (Advertising and Claims) Regulations 2018.
The companies were ordered to show cause within a specified period why action should not be taken against them, the regulator said.
