Former DGP Tomin Thachankary approaches Kerala HC in appeal against disproportionate assets conviction

Former Director General of Police Tomin J. Thachankary on Friday approached the Kerala High Court against the vigilance court’s order convicting him in the disproportionate assets case. Mr. Thachankary alleged that the prosecution miscalculated his rental income, property income, payments made by his relatives and property acquired by his wife. He argued that the trial court failed to consider his amended income tax returns.

He also claimed that the vigilance court did not take into account his wife’s income from her commercial and agricultural properties. The trial court did not consider the actual income he received during the investigation period but took into account expenses he did not actually incur, he argued. Mr. Thachankary further submitted that the trial court should have taken cognizance of the assessment of income tax only after the registration of the offence.

A vigilance court sentenced Mr. Thachankary to four years’ rigorous imprisonment and a fine of ₹30.84 lakh on 17 September. Single Judge A. Badharudeen will hear the plea on September 22. The charge sheet filed by the Vigilance and Anti-Corruption Bureau said that Mr. Thachankary received an addition to his declared sources of ₹₹ from income.
