FIR against former CM Mamata Banerjee over alleged communal remarks in Bengal

A First Information Report (FIR) has been registered against former West Bengal Chief Minister and Trinamool Congress supremo Mamata Banerjee for allegedly making provocative and communal remarks during the last assembly election campaign, a senior police officer said on Friday (Jun 12, 2026). At the rally, Ms. Banerjee reportedly told the minority community that their security depended on her political presence, without which they would be destroyed.
“It is a Zero FIR which was lodged on June 7. It was initially lodged at the Netaji Nagar police station on the basis of a complaint filed by an individual Tushar Kanti Das (45). However, the case was later transferred to the Hare Street police station,” the officer said.
In his complaint, Mr. Das alleged that during the protest against the Special Intensive Review (SIR) exercise at Dharna Mancha in Esplanade on March 9, Ms. Banerjee made a misleading speech regarding intimidation of criminals with the intention of provoking breach of peace, affecting public tranquility, social harmony of the state and the democratic fabric of the state.
“Minorities depend on TMC” for security
A copy of the complaint seen by The Hindu read: “Ms Mamata Banerjee, then Chief Minister of West Bengal and President of the All India Trinamool Congress, while addressing a political rally, warned the public not to be misled by the Bharatiya Janata Party’s alleged ‘misleading publicity’. However, it was not clear enough what the specific misinformation or misrepresentation was.”
He alleged that during the rally, Ms. Banerjee had addressed a particular minority community and said that their security depended on her political presence. “Aamra achhi bole apnara bhalo achhen sobai. R jodi aamra na thaki…ek second e debe akdom barota bajiye…jodi nijeder terota bajate na chan, BJP er opo prochare keu bhul bujhben na. (You are all safe because we are not here, we don’t want to destroy. If they destroy us. you yourselves, don’t pay attention to BJP’s misleading words),” Ms Banerjee told the rally, according to Mr Das’s complaint.
The statement prima facie appears to be provocative, inflammatory and capable of promoting communal disharmony, fear, hatred, misunderstanding and tension between different communities, he said in the FIR.
‘Can stimulate communal moods’
“The statement may reasonably be perceived as causing apprehension and uncertainty in the minds of ordinary citizens and, if unchecked, may adversely affect public peace, harmony in society and the democratic atmosphere of the state. I respectfully declare that speeches or statements that may inflame public sentiment, spread fear or disturb the rule of law among various groups may be contrary to the laws of various groups.” he urged in the FIR.
The case was filed under Sections 96(1), 351(2) and 352 of the Bharatiya Nyaya Sanhita.
Another FIR was lodged against Ms Banerjee on May 27 for allegedly making derogatory remarks about Sanatan Dharma when she attended an Eid celebration in Kolkata last year. The complaint, filed by advocate Rinki Chatterjee Singh at the Siliguri Cyber Police Station, accused the TMC supremo of referring to Sanatan Dharma as “ganda dharma (dirty religion)”, which “deeply hurt the religious sentiments and beliefs of millions of followers”.
