The bench Madurai of the High Court in Madras canceled the closure of the case registered by the Police of Toothukuku over the procedure of social media, which does not respect Lord Krishna.
The justice of K. Murali Shankar noted: “The depiction of the Hindu gods in a disrespectful way, deliberately damaging the sentiments of millions, cannot be justified. Such actions have the potential to induce hostility, religious outrage, social disorder and undermine municipal harmony”.
The court said, “Given the deeply rooted respect for religious symbols and deities, disrespect may lead to social riots and injure a large part of society. Therefore, it is essential to approach such depictions with sensitivity.
The court listened to the petition of criminal revision given by P. Paramasivan. The petitioner filed a complaint that claimed that one Sathish Kumar published a photo of Lord Krishna along with disrespectful comments on social media. He said he was deeply injured by a distorted photograph that caused him a significant mental anxiety. He claimed that Sathish Kumar published a photo and comments with the intention of gossiping the Hindu gods, damaging the image of Hindu women, and potentially creating a problem of law and order by supporting hostility between different groups for religious reasons.
Based on the complaint, a company was registered. Subsequently, the police submitted the final report before the judicial Judge IV, thoothuku as “undetected”. The acceptance of the final report was closed with freedom to file a private complaint. The same was the criminal revision petition.
Justice Murali Shankar noted that the last report of the police and the order approved by the judge receiving it and the closure of companies could not be legally maintained. While the investigative officer identified the potential of position to create laws and order and disrupted the municipal harmony, the investigation was not strictly monitored and seemed to have been submitted mechanically, the court noted.
Despite the seriousness of the police accusations, the police dealt with the case randomly. “Given these circumstances, the court considers it necessary to order the police to continue and complete the investigation in the specified period,” the judge noted, ordering the police to complete the investigation and submit the final report in three months.
