
On Tuesday, the Kerala High Court canceled the criminal proceedings initiated against a student of law, who was accused of disrespect for the statue of Mahatma Gandhi on his university campus in Aluva in 2023.
Reportedly he placed a few sunglasses and a Christmas wreath on the statue and added that “Gandhi has been dead for a long time”. The video recording was also published in the WhatsApp students, after which a complaint with the director was filed. Subsequently, the criminal case was registered and was suspended for a university for five days and ordered to disappear 5,000 GBP as well.
Bench of justice VG ARUN, which allowed the student’s request to cancel the case, stated that the alleged act was undoubtedly immoral. However, it cannot be considered unlawful if there is no law that has banned such conduct or prescribed punishment for such conduct. The court stated that every Indian citizen had a moral duty to respect freedom fighters who played a key role in the liberation of the country from the colonial government.
