President Aimim Assaddin Owaisi expressed dissatisfaction with the Supreme Court’s order on Monday in the WAQF Act (amendment) and feared that this could lead to remuneration of “WAQF’s real estate interveners”.
In an interview with NDTV On Tuesday, Aimim chief spoke of the provision in the WAQF Act (amendment) that requires a person to practice Islam for at least five years before the creation of WAQF.
“The devil will be in detail. Is there a rule for anyone who adopts religion such as Hinduism, Christianity, Sikhism, Buddhism, that some rules will be done before he can endow his own property he has accepted?
On Monday, the Supreme Court took care of some of the key provisions of the WAQF Act (amendment) 2025, including the clause that only those who have been practicing Islam over the past five years could create a WAQF, but refused to remain the whole law that indicates constitutionality in its favor.
When Owaisi asked his response to the order, NDTV said, “The government is not interested in protecting the WAQF system at all. They called the idea that is foreign to our country. And with the Supreme Court, the main changes will not remain.
Owaisi also claimed that while the number of non -Muslims in the WAQF councils was limited, the clause in the act itself is a violation of Article 26 of the Constitution, which provides religious designations and sections of freedom over their religious affairs, institutions and property.
He asked how non -Muslims were included in the WAQF boards when the same does not apply to the advice of Hindu foundations, the Sikh Gurdwara ParBandhak, or Trust Bodh Gaya Trust.
“I feel that the Honorary Supreme Court must initiate the final hearing of the benefit against this act and we will submit these views again. However, yesterday it was not a good day to protect real estate WAQF,” said the chief.
Soon after Monday’s order of the Supreme Court on Monday, Assaddin Owaisi stated that the Provisional Order would not protect WAQF real estate from the WAQF Act (amendment), 2025, which made the NDA and hopes that the court will soon declare the final judgment on the entire legal regulations.
“In my opinion and the opinion of my party, the temporary order will not protect WAQF real estate from the law that the government has done … Encroachers will be rewarded, no development will be in the WAQF properties.
