On Monday, the High Court in Delhi dismissed an interim lawsuit for a court lawsuit filed by the IPL Royal Challengers Bangalore (RCB) against Uber Moto over the allegedly disappointing advertising on Youtube with the cricket head of Travis Sunrisers Hyderabad (SRH).
Judge Saurabh Banerjee rejected the RCB request for a provisional court order and noted that the contested ad at this point did not guarantee any intervention.

“The attacked advertising is in the context of a game cricket, a sports behavior game that, in the opinion of this court, does not require any interventions at this stage,” Livelaw quoted the High Court in Delhi.
“Moreover, because if the current one is, the intervention of this court at this stage would settle to fall, which would allow the plaintiff to run on water with the assurance that they will not decrease. In accordance with this, this application is dismissed,” the court added.

Uber Moto’s Hyderabaddie Advertising with Travis Head
The Uber YouTube ad, which is part of the Hyderabaddie campaign, contains Cricter Travis Head, which plays for Sunrisers Hyderabad. In the ad, the head shows a playfully changing banner that reads “Royally attacked Bengaluru,” a pun focused on the competing IPL team Royal Challengers Bangalore (RCB).

The advertisement, which was supposed to promote the Uber’s Bike Taxi Service, caused controversy because RCB claimed that it had disabled their brand and broke their trademark.
What is the case of RCB against Uber?
Royal Challengers Bengalur (RCB), the Indian Premier League (IPL) franchise, initiated legal proceedings against Uber India Systems PVT LTD at the Dilli High Court for the controversial advertising issued by Uber.

In the ad, Travis Head is displayed to sneak at the stadium before the Bengaluru Versus Hyderabad IPL and the battalion to read the “Royally attacked Bengaluru”, the play in the name of the RCB.
This act associated with the use of RCB slogan “EE Sala Cup Namde” was hardened by RCB to disparage and dilute their trademark and identity of the brand.

RCB claimed that Uber’s advertising was unauthorized use and distortion of its trademark, which is a commercial mockery and dilution of the brand, especially because Uber Moto is a commercial sponsor SRH, the IPL competing team.
The franchise was looking for an interim command to limit Uber to broadcast advertising.
Uber, on the other hand, prevented advertising as a form of commercial free expression and marketing and rejected the action as unfounded. The High Court in Delhi, while acknowledging Prima Facia’s merit in RCB demands, has reserved its order for temporary relief.
