
On Tuesday, the Delhi court rejected the aap of the former AAP MLA Balayna in the case of McOc.
Police in Delhi said against Balean’s request that there was no change in circumstances, except for the time spent in custody.
The police added that the accusations against the accused are serious and that the additional fee certificate according to sections 3 and 4 MCOCA (Maharashtra control of the Organized Crime Act) has already been filed against it.
Balyan was arrested on December 4, 2024 in connection with the syndicate of organized crime, the allegedly operated gangster Kapil Sangwan aka Nanda.

In court, special prosecutor (SPP) Akhand Pratap Singh, who appeared for the police in Delhi, strongly opposed requests for bail.
Singh said that the predecessor had already dealt with the advocate’s arguments when deciding on the previous request for bail.
“There is no new reason for bail search,” SPP said, adding that Balayan had previously canceled his appeal against the order to reject the bail of the court from the High Court.
The advocate Mrs. Khan appeared for Ballean, along with the advocates of Rohit Kumar Dalal and Rahul Sahani.
During the court proceedings, the advisor of Narnesh Balayna questioned on the basis of the case and said that the consent to the registration of companies under McOca was not valid.
Therefore, the whole proceedings were invalid, said the council.
The defense said Balayan had been in custody since December 4, 2024, although McOca approval was reportedly erroneous.
On 30 November 2024, Balayan was arrested in another case and was awarded a bail. In the current case, however, Mcoca was again arrested immediately after securing the deposit in the previous case.
The Balyan Council said that the only basis for his implication under McOca is a sound clip that allegedly represents interviews between Sangwan and the former AAP MLA.
The defense argued that the clip had been known to the police for more than a year and that the police had stated the court by claiming that the clip came to the announcement of the investigating officer (IO) only after the company was registered on 28 August 2024.
On May 5, the Rouse Avenue Court received an additional fee certificate filed against Nanesh Balayan and three other accused: Sahil alias fields, Vijay Gahlot aka Kalu and Jyoti Prakash.
The additional certificate on the fees, the second in the case, is the first to name Balayna as the accused. It was submitted according to sections 3 and 4 MCOCA. Section 3 was called against three accused.
