
The Additional Chief Judicial Magistrate Court in Thiruvananthapuram on Saturday rejected the bail plea filed by YouTuber Rahul Easwar, who is accused of defaming and revealing the identity of a woman who accused Palakkad MLA Rahul Mamkootathila of rape and forced termination of pregnancy. A lawyer appearing for Mr. Easwar argued that the video shot by the accused only showed him reading the First Information Report (FIR) registered in the rape case and did not contain anything defamatory of the complainant. He also expressed willingness to take down the post from social media platforms.
However, the prosecution claimed that Mr Easwar did not cooperate with the investigation and had to be re-interrogated in custody. The prosecution also argued that Mr Easwar had previously published defamatory posts defaming the survivor’s name and granting bail in this case would send a bad message to society.
The court then dismissed the claim.
The police team investigating the case has decided to interrogate Mr. Easwar in custody and a remand application will be filed in the court soon.
Meanwhile, Mr. Easwar, who was arrested by the Cyber Police, was admitted to the Government Medical College Hospital in Thiruvananthapuram after his condition deteriorated. Mr. Easwar has been on hunger strike since he was admitted to jail. Mr. Easwar also applied for bail in the District Court. His plea was heard by the Additional Chief Magistrate’s Court on Saturday after the bail application filed in the District Court was withdrawn.
