There is a debate in police circles about the tenure of appointee Sandeep Rai Rathore Tamil Nadu‘s Director General of Police and Director of the Police Force on instruction Election Commission of Indiain place of G. Venkatramana, in-charge DGP/HoPF.
The posting is promotional as Mr. Rathore will be eligible for the Apex Scale (Level 17 of the pay scale), equivalent to the rank of Chief Secretary. However, the EC regulation did not specify his term of office. The question is whether Mr. Rathore would be entitled to a minimum two-year term. The Supreme Court in the landmark Prakash Singh case held that a state DGP/HoPF should have a minimum tenure of two years, irrespective of the date of superannuation. However, this decision applies to appointments made through the process conducted by UPSC.
