The High Court in Delhi noted that if two adults are, even if one is married, they decide to live together or have a sexual relationship, they must also accept responsibility for the consequences of this decision.
The justice of Swaran Kant Sharma in the sentence issued on September 10 noted that “it is not open to one side, after the relationship becomes acidic to retrospectively paint it as a crime of sexual assault”. The observation came when the case of rape against a man employed as a pilot for a complaint of a cabin member came.
The complainant claimed that she had been exposed to repeated sexual intercourse under false promises of marriage, although he was accused of being married and forced to undergo three abortion in August 2018, April 2019 and June 2020.
The man who was awarded a predictor’s bail by the court that the relationship had been consensual from the beginning, without the promise of marriage, divorce or secrecy of his family status.
The court acknowledged that the woman was aware of the man’s family status at the beginning, yet she continued his relationship for more than two years.
“In this context, when an educated woman decides to continue her relationship with a man, even though they know he is married, he will also take responsibility for this choice,” the court said.
“It must acknowledge the possibility that the relationship does not have to culminate in marriage, or that it can eventually become acid.
