The chief judge of Upiphyaya was as strong and suggested a petition as a frivolous use of judicial time.“It is just a wasting time of trial and time. Tell us about the national team in any sport selected by government officials. Whether they are Commonwealth, Olympics, Hockey, Football or Tennis – aren’t India?”Kansal Pil claimed that BCCI, registered under the Act on the Registration of Tamil Nadu companies, is not a legal body or a “state” under Article 12 of the Constitution. He also claimed that he refers to the team as “India” or the use of the National Flag violated the Act on EMBLES AND NAMES (prevention of incorrect use) of 1950 and the Indian Flag Code of 2002.The bench, however, rejected these statements and observed that the use of a flag or national name for sporting in sport does not mean abuse.“If you want to develop a flag in your house, is it forbidden?” The court noted.The judges also noted that international sports authorities, such as the International Olympic Committee (IOC), will discourage government interference with sports administration.In the end, the court rejected and reaffirmed that the Indian cricket team – regardless of the BCCI private status – represents a nation in every sense.
