On Thursday (April 10, 2025), India Bloc required the abolition of section 44 (3) of the Digital Personal Data Protection Act (DPDP) and claims that it destroys the Act on Information (RTI).
At a joint press conference in the new Delhi leader Gaurav Gogoi, he said that more than 120 Indian blocks deputies, including the opposition leader Rahul Gandhi, signed a common memorandum to abolish this section and will be submitted to Ashwini Vaishnaw.
At the press conference, MM Abdulla (DMK), Priyanka Chaturvedi (Shiv Sena-Obt), John Brittas (CPI-M), Javed Ali Khan (SP) and Naval Korkor (RJD).
Activists for civil rights opposed section 44 (3) of the DPDP Act, which seeks to replace Section 8 (8). 1 (a). J) of the 2005 RTI Act, Mr. Gogoi said.
The provisions of § 8 para. (J) of the RTI Act made it possible to withhold personal data if its publication was not related to any public activity or interest or would result in an unjustified invasion of privacy.
However, this restriction was subject to an important guarantee: if the central public information official, the state public information official or the appellate body found that the publication of the information delivered to the greater public interest may still be available.
Section 44 (3) of the DPDP Act changes Section 8 (1) (a). (J) of the RTI Act, which allows government bodies to detain “information concerning personal data”, regardless of the public interest or another exception.
