The Criminal Investigation Department (CID) filed a chargesheet against 17 accused in the murder case of real estate agent VG Shivaprakash alias Bikla Shiva in a city court on Monday.
However, CID is yet to file charges against BJP MLA for KR Puram Byrathi Basavaraj (Accused 5 in FIR) as he is absconding and CID teams are searching for him in connection with the case. This is only the first charge and additional charges will follow as the case continues to be investigated, sources said.
On December 19, the High Court struck down the Karnataka Control of Organized Crime Act (KCOCA), 2000, invoked against him in the case, but denied anticipatory bail, but asked him to approach the sessions court for the same. Mr. Basavaraj filed an anticipatory bail plea in the Court of Appeal on Saturday, which was heard on Monday. The court adjourned the case to Tuesday without granting the petitioner a preliminary injunction.
Several CID teams are looking for Mr. Basavaraj with the intention of arresting him as the court has not granted him an interim measure. Sources said the CID is also working to issue a look-out notice against the MLA.
Meanwhile, the CID is all set to file a Special Leave Petition (SLP) in the Supreme Court challenging the Supreme Court’s recent order quashing the appeal of KCOCA, 2000 in the case. Supreme Court.
